Election by the state legislature with each chamber voting separately. Nelson received 45 of 61 votes in the state Senate with Schallar receiving 14 and Johnson and Day receiving one vote each. Nelson won 98 of 114 votes in the state House with 13 for Schallar and three for Dean. The legislature declared Nelson the duly elected U.S. Senator in a joint convention on January 23, 1907.

Schaller was an attorney from Hastings, former Dakota County Attorney (1879-1891), former Hastings City Attorney (1891-1897), and sitting state Senator (SD 24, 1895-1899; SD 30, 1899-1915). He would later serve as an Associate Justice of the Supreme Court (1915-1917).
Dean was a former Prohibionist gubernatorial and state legislative nominee.
Johnson was a former newspaper editor from Saint Peter, former state Senator (SD 20, 1899-1903), and sitting Governor (1905-1909).
Day was a former state Representative (HD 38, 1878-1879), state Senator (SD 06, 1887-1895; SD 09, 1927-1928), and Lieutenant Governor (1895-1897).
