Election by the state legislature with each chamber voting separately. Davis won 43 of 60 votes in the state Senate with Towne receiving 17. Davis won 93 of 118 votes in the state House with Towne receiving 25. The legislature declared Davis the duly elected U.S. Senator in a joint convention on January 18, 1899.
Senator Davis was reelected to a third term. However, Davis died in office on November 27, 1900 and Towne was appointed to the seat by Governor John Lind.
Towne was an attorney from Duluth, former judge advocate general of Minnesota (1893-1895), former Republican U.S. Representative (CD 06, 1895-1897), and Democratic U.S. Representative from New York (CD 14, 1905-1907).
