Governor Harold Stassen appointed Maynard Pirsig to fill the vacancy on October 6, 1942. Pirsig was a professor at the University of Minnesota Law School.

Vanderburgh was an attorney from Minneapolis, candidate for Associate Justice of the Supreme Court in 1918, 1920, 1922, 1924, and 1928, and nominee for Associate Justice of the Supreme Court in 1926, 1930, 1932, and 1934. He was the son of Charles Vandenburgh, Associate Justice of the Supreme Court from 1882-1894.
