Associate Justice Quinn was reelected to a second term. Quinn resigned from office on January 1, 1928. Governor Theodore Christianson appointed Clifford Hilton to fill the vacancy on January 1, 1928. Hilton was a resident of Fergus Falls, sitting Attorney General (1919-1927), former Fergus Falls City Attorney (1896-1898), former Otter Tail County Attorney (1899-1909), and former assistant Attorney General (1909-1917).

Anderson was a resident of Minneapolis and nominee for Associate Justice of the Supreme Court in 1924 and 1934. He was endorsed by the Farmer-Labor party.
